Ollie Voak – Terms & Conditions 2026

The Terms & Conditions the photographer/videographer/s shall mean any representative of Ollie Voak.

It is agreed that the terms set out in this schedule are the total agreements made between the parties and that no variations or modifications of this contract shall be effective unless agreed by both parties in writing.

1. Provision of Services

Ollie Voak shall provide the agreed services with reasonable skill, care, and professionalism in accordance with industry standards.

Ollie Voak may subcontract or substitute photographers, videographers, editors, or drone operators where reasonably necessary (for example due to illness or availability), provided such persons are suitably qualified and experienced.

Start and finish times will be discussed and agreed in advance. Ollie Voak will, in consultation with the Client, determine appropriate arrival and departure times to best achieve the agreed outcome.

2. Special Requests & Coverage

The Client understands and accepts that film and photographic coverage will be delivered according to the professional judgement of the photographer/videographer/s. No individual clip, photograph, or moment shall be deemed more important than another unless expressly agreed in writing.

Special requests are not binding instructions, although every reasonable effort will be made to comply. Any special requests must be provided in writing prior to the shoot.

The Client is responsible for identifying (or appointing a representative to identify) key people, objects, or moments to be filmed or photographed. Ollie Voak shall not be held responsible for missed content where no such assistance is provided.



3. Artistic Licence & Technical Limitations

The photographer/videographer/s shall have full artistic licence in relation to shooting style, composition, locations used, poses filmed, and the length and structure of the final edit. The photographer/videographer/s’ judgement shall be final.

Due to lighting conditions, weather, subject behaviour, and technical constraints, it may not be possible to capture all requested footage.

Colour balance will be adjusted to produce a pleasing result, but exact colour matching cannot be guaranteed as it is not always possible to replicate colours perceived by the human eye.

4. Client Responsibilities & Delays

The Client shall ensure timely access to locations, subjects, permissions, and any required information.

Ollie Voak shall not be liable for delays, additional costs, or failure to deliver specific content caused by acts or omissions of the Client, their representatives, or third parties.

Any additional time required as a result of such delays may be charged at the agreed or standard hourly rate.

5. Copyright & Licence of Use

All photographs, video footage, digital files, rushes, and edits remain the intellectual property of Ollie Voak.

Upon full payment of all fees due, the Client is granted a perpetual, non-exclusive, unrestricted licence to use the delivered content for any lawful purpose, including copying, sharing, printing, and publication.

No licence is granted until payment has been received in full.

Ollie Voak is under no obligation to supply additional images or footage outside the agreed deliverables. Any additional content supplied shall be at Ollie Voak’s discretion and may incur additional charges.


6. Display & Promotion

The Client grants Ollie Voak the unrestricted right to use any images or video produced under this Agreement for self-promotion, including but not limited to websites, social media, portfolios, advertising, publications, and commercial materials.

7. Deliverables & Revisions

Deliverables form part of post-production. Once the first version of an edit is delivered, the Client is entitled to two (2) rounds of reasonable amendments.

Any additional revisions or changes outside the agreed scope may be charged at the standard hourly rate.

Bad Weather Definition

“Bad Weather” means conditions that make it unsafe or impractical to carry out the shoot, including but not limited to:

  • High winds preventing safe drone operations under UK CAA guidance.

  • Heavy rain, thunderstorms, or lightning risk.

  • Conditions risking damage to equipment or safety of crew or clients.

  • Visibility insufficient to meet reasonable quality standards.

The decision as to whether conditions constitute Bad Weather rests solely with Ollie Voak.

9. Fees, Deposits & Payment

Fees and quotes shall be agreed in advance. Ollie Voak reserves the right to request up to 50% of the total fee upfront.

Invoices are payable within the agreed timeframe. Delays in payment may result in variations to delivery schedules or increased costs.

If any invoice remains unpaid for more than 14 days after becoming due, Ollie Voak reserves the right to suspend services, withhold delivery of content, or terminate the Agreement without liability.

10. Force Majeure

Neither party shall be liable for failure or delay in performance due to events beyond reasonable control, including severe weather, illness, equipment failure despite reasonable precautions, or government restrictions.

11. Limitation of Liability

Except in cases of death, personal injury, fraud, or wilful misconduct, the total liability of either party arising out of or in connection with this Agreement shall be limited to the total fees paid under the contract.

Neither party shall be liable for indirect, special, or consequential loss, including loss of profit, revenue, or business opportunity.

12. Personal Injury

Any directions issued to Clients, guests, or employees during a shoot are followed at their own risk. The photographer/videographer/s shall not be held responsible for personal injury sustained during a shoot.

13. Model Releases

The Client is responsible for obtaining all necessary permissions and model releases for persons appearing in the content, unless otherwise agreed in writing.

14. Storage & Rushes

Project rushes will be stored for a maximum of five (5) years, after which they may be deleted.

Rushes may be supplied to the Client upon request. Any such handover may be subject to an additional fee agreed in advance.

15. Confidentiality

All confidential information disclosed by either party shall be kept confidential and used solely for the purpose of performing this Agreement.


16. Severability

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Jersey, Channel Islands.

18. Survival

Clauses relating to copyright, licence of use, liability, confidentiality, and governing law shall survive termination of this Agreement.




Bad Weather Definition

“Bad Weather” means weather conditions that make it unsafe or impossible to carry out the shoot as planned, including (but not limited to):

High winds resulting in unsafe drone flights under UK CAA recommendations.

Heavy rain, thunderstorms, or lightning risk.

Conditions that would damage equipment or risk safety of crew/clients.

Visibility is so poor that footage/photos cannot reasonably meet agreed quality standards.

The decision as to whether weather conditions constitute “Bad Weather” shall be made solely by Ollie Voak, taking into account safety, practicality, and quality considerations.

Limitation of liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Personal Injury

Any directions issued to Clients, their guests or employees during a shoot are deemed to be at said person's own risk. The photographer/videographer/s cannot be held responsible for any personal accidents during a photo or video shoot of any kind.

Quotes and Fees 

Quotes and fees will be discussed and agreed between the Client and Ollie Voak prior to the project. Ollie Voak reserves the right to request up to 30% of the full invoice upfront for certain projects. Delays in payments may result in variations to delivery schedules and increased costs. 

Shooting Schedule

Start and finish times will be discussed between the Client and the photographer/videographer/s. The photographer/videographer/s will, in consultation with the Client, determine the best time to arrive and leave.

Model Release

The Client hereby assigns and grants Ollie Voak the unrestricted right to use and publish any content from the production. The Client undertakes responsibility for all model releases and agrees to provide a release form for any other persons to be photographed/filmed. 


Storage

Rushes will be stored for a maximum of 5 years before being deleted. Ollie Voak may handover all project rushes to the Client at their request. A fee will be calculated prior to this arrangement.

Severability 

If any provision of these Terms is held to be invalid or unenforceable under any applicable, the validity of these Terms as a whole shall not be affected, and the other provisions shall remain in full force and effect.


Governing Law

This agreement will be governed in accordance with the laws of Jersey Channel Islands.

Confidentiality

All Confidential Information disclosed by a party to the other party (before or after the date of the Agreement), shall be held in confidence and used only for the purpose of performing the Agreement and using the Deliverables.
